What does this mean: judgement of district court vacated; case remanded with instructions to dismiss?
This comes from a U.S. Supreme Court order. It states:
"The judgment of the United States District Court for the Northern District of Mississippi is vacated, and the case is remanded with instructions to dismiss the complaint for lack of jurisdiction. "
What exactly does this mean???
Yes, thank you. But what does that MEAN?
What that means is that the judgment, or the final decision of the lower court, is not longer valid. For example, you sue your friend for $100 and win. The judgment is the court's determination that you are the winner and entitled to the money. When a judgment is vacated, it is overturned, or thrown out. In other words, it no longer applies. Back to the example, you would no longer be the winner. "Remanded" means that the case is being sent back to the lower court in order for the lower court to take some action. In your question, the case is to be dismissed, meaning the whole case will be tossed out of court, and it will be as if it never came to court at all. Both parties are right back where they started.
